My boss called me today and fired me because they did a background check on me. I have been working for them for a year already and employment was supposed to be subject to a background check and credit check. However, a year later, they fired me. Can I sue them and win?



Here%26#039;s the catch, they hired me as contract labor and had me fill out the tax form stating so when they hired me.

Your employer is more than likely a dirtbag if he had you fill out the 1099 because that just means he is too lazy to take care of your witholding and is probably trying to beat workers comp. It really doesn%26#039;t matter how they hired you though.



An employer has no obligation to keep an employee who they have reason to believe may be detrimental to the business. In your case, if you try to sue, it will more than likely be thrown out because #1 you understood from the start that your employment was subject to a criminal background check and #2 your employer was justified in firing you because you have a history which demonstrates your ability to be destructive to the business.

As a contract laborer, you weren%26#039;t even an employee. If you lied on your original application, they could sue you for fraud, so you better just move on quietly.

With some branches of the federal gov%26#039;t. for example, you have to maintain a clean background check and good credit(credit b/c they say that you are more likely to take a bribe if you have bad credit). where do you get anything they did was wrong? you said employment was based on a background search.there is no limit on when the have to use the search. they fired you for what was found in you background. that is perfectly legal.what in the world would you sue them for?what is the deal with contract labor, what is supposed to be wrong with that. you signed a form agreeing . this just sounds all made up
